EN: Purchasing Rules

Purchase Rules

By checking the box "I agree to the Purchase Rules," you confirm that you have thoroughly reviewed the Purchase Rules, understood them, and agree to and undertake to comply with the conditions set out therein.

1. General Provisions

1.1. The Picwall.com / Picwall.lt website is an electronic platform where the Visitor is given the opportunity to view, select, and purchase wall coverings (wallpapers, canvases). Wallpapers may be purchased from the design catalog provided by Picwall or ordered as individual (custom) products based on visual data (photos) submitted by the Visitor. Canvases may only be purchased from the design catalog provided by Picwall, according to designs and dimensions predetermined by Picwall; custom (personalized) canvas production based on data submitted by the Visitor is not available.

1.2. Service Provider — the private legal entity administering the Picwall.com and Picwall.lt websites (hereinafter — the Picwall website), registered and operating under the laws of the Republic of Lithuania: Code & Crafts, UAB, company code 307394547, operating at Utenos g. 41D, LT-08217, Vilnius.

1.3. Visitor — a person who visits the Picwall website and uses its functions, including selecting designs, creating custom orders, and making purchases.

1.4. Only the following persons are entitled to use the Picwall website and to order and purchase Picwall products (hereinafter — Picwall Product):

  • legally capable natural persons, i.e., persons who have reached the age of majority and whose legal capacity has not been restricted by a court;
  • minors between sixteen and eighteen years of age, only with the consent of a parent or guardian, unless they have permission to independently exercise all civil rights or fulfill civil duties;
  • legal entities;
  • authorized representatives of all the persons listed above.

By purchasing Picwall Products on the Picwall website and confirming agreement with these Rules, the Visitor declares that they meet all the conditions set out in Clause 1.4 and have the right to enter into a purchase-sale agreement with the Service Provider.

1.5. Purchase Rules — these Rules for using the Picwall website and purchasing the Picwall Product (hereinafter — the Rules) constitute a legally binding document for the Visitor and the Service Provider (hereinafter jointly — the Parties), establishing the procedure and conditions for using the Picwall website, the rights and obligations of the Parties regarding the use of the Picwall website and the acquisition, payment, delivery, and return of Picwall Products, as well as other provisions related to ordering, purchasing, and selling Picwall Products.

1.6. The Service Provider has the right to change, supplement, or amend the Rules at any time. The most current version of the Rules is published on the Picwall website in the "Purchase Rules" section. Amendments to the Rules take effect immediately upon publication on the Picwall website. The Service Provider is not obligated to notify Visitors of changes to the Rules. We recommend periodically visiting the Picwall website to review the latest version of the Rules. If significant changes are made, this will be announced on the Picwall website.

1.7. The Service Provider reserves the right, at any time and without prior notice, to update, change, or supplement the Picwall website, its content, the range of Picwall Products offered, and to temporarily or permanently discontinue the provision of services. These changes do not affect orders that have already been confirmed and paid for, which will be fulfilled according to the purchase conditions in effect on the Picwall website at the time the order was placed.

2. Personal Data Protection

2.1. The Service Provider undertakes to respect the Visitor's right to privacy regarding their personal information. When processing personal data, the Service Provider is guided by the Law on Legal Protection of Personal Data and other legal acts regulating the processing of personal data, as well as by the Visitor's consent, which may be obtained for a specific case, for e-commerce, direct marketing, surveys, contests, and games. More information can be found on the Picwall website in the "Privacy Policy" section.

2.2. By registering on the Picwall website, purchasing a Picwall Product, and providing their data to the Service Provider, the Visitor agrees that the Service Provider may collect, manage, process, and store the personal data or other information provided by the Visitor, and use such information for the purposes of providing Picwall website services and fulfilling the purchase-sale agreement under the conditions set out in the Rules.

2.3. By using the services of the Picwall website, the Visitor confirms that they have reviewed the personal data processing rules.

3. Visitor Registration and Conclusion of the Purchase-Sale Agreement

3.1. The Visitor may place orders for Picwall Products on the Picwall website in two ways:

3.1.1. Without registration. a) Registration is not required for website visitors who wish to browse the product design catalog, prices, informational texts, or try out the basic Picwall product design tools. The Visitor also has the right to place an order and purchase a Picwall Product from the Service Provider's catalog without creating an account (as a guest).

3.1.2. With registration. a) In order to use the website tools for creating custom-design products or uploading personal photos, the Visitor must register and create a registered Visitor account by providing a valid email address, first and last name, and phone number, which are necessary to create their personal environment and to receive information at the specified phone number regarding the ordering and delivery of Picwall Products.

b) We recommend choosing your password carefully when registering on the Picwall website and not sharing it with others! The Visitor is responsible for the disclosure of login credentials to third parties. If third parties use the Visitor's login credentials, the Visitor is responsible for the actions taken by that third party.

c) After registering on the Picwall website, the Visitor may indicate in their profile that they wish to receive Picwall newsletters via their chosen method (email and/or SMS). By selecting these options, the Visitor agrees that the Seller may process the personal data provided (email address and/or phone number) for direct marketing purposes. A minor (i.e., a person aged 16 to 18), by giving such consent, confirms that the consent given for the processing of their personal data for direct marketing purposes has been agreed upon with, and is not objected to by, the minor's parents/guardians/carers.

d) The Service Provider is not responsible for, and does not verify, the authorship of photographs, illustrations, or textual material used by the Visitor, nor is it responsible for the facts, subject matter, circumstances, or content errors in such material, and does not check these. It is likewise not responsible for, does not control, and does not represent the Visitor's activities. The provision of services does not mean that the Service Provider in any way endorses or supports the Visitor's actions or the content of publications. The Visitor understands and confirms that they are solely responsible for any and all information and content they post on the Picwall website.

e) When creating their individual product on the Picwall website, the Visitor must comply with copyright law and other legal acts and general principles. By uploading their photos, images, illustrations, designs, or other visual material to the Picwall website, the Visitor confirms that they have the right to use such content and assumes all risk related to any possible violation of third parties' privacy. The Service Provider recommends that the Visitor obtain the consent of any third parties before uploading their photos or information about them to the Picwall website.

f) Content posted or used by the Visitor for Picwall Products (e.g., photos, illustrations, information, and other content) on the Picwall website remains the property of the Visitor. In order to receive the Picwall website service, the Visitor grants the Service Provider the right to reproduce by printing and to perform other related services, including storage, of the content posted/used by the Visitor.

g) The Service Provider reserves the right, at its own discretion, to remove information that is prohibited by law or contrary to established norms of conduct and morality from the Picwall website, or to suspend or refuse to fulfill an order if there are reasonable doubts about the legality of the uploaded content or if the content potentially violates applicable legal acts.

3.2. All material presented on the Picwall website, including Picwall product designs, graphic elements, texts, and other intellectual content, is the exclusive property of the Service Provider. It is prohibited to copy, distribute, transfer to third parties, or use this content for any other commercial purposes. The Visitor is granted the right to use the content of the Picwall website only for personal, non-commercial purposes — for the individual creation and purchase of wall coverings (wallpapers).

3.3. All Visitors are fully responsible for their actions on the Picwall website and must observe established norms of conduct and morality and use the services in a manner that does not endanger the proper functioning, security, or integrity of the Picwall website and/or its services, including but not limited to uploading invalid data, spreading viruses, restricting other persons' ability to use the Picwall website and/or its services, and damaging the good name and reputation of the Picwall brand.

3.4. All Visitors undertake to respect the rights and dignity of every person and to refrain from insults, mockery, unpleasant or inappropriate comments used in Picwall product content that directly or indirectly humiliate/insult another person, that offend or harm another person, or that publish any defamatory, vulgar, offensive, discriminatory, or otherwise unlawful content, including any content that could give rise to any legal liability for the Service Provider.

3.5. Both registered and unregistered visitors have the right to discontinue use of the Picwall website's services at any time by submitting a request to the Service Provider at the email address listed on the Picwall website in the "Contacts" section, sending it from the email address specified during registration on the Picwall website.

4. Ordering

4.1. When creating and placing an order to purchase a Picwall Product from the Service Provider's catalog, i.e., without creating an account (as a guest), the Visitor's data (first and last name, phone number, email address, delivery address) is provided solely for the purpose of fulfilling that specific order.

4.2. When creating a personal/custom wallpaper product and uploading personal visual content (photos, illustrations, graphic files, hereinafter — uploaded content), the Visitor:

a) assumes full legal responsibility for the uploaded content (photos, graphic elements, texts). It is strictly prohibited to upload, distribute, or use content that violates the laws of the Republic of Lithuania, incites hatred, discrimination, or violence, or is pornographic, offensive, or contrary to public order and standards of morality. The Service Provider reserves the right to refuse to fulfill an order if the uploaded content is inappropriate, without having to explain the reasons.

b) undertakes to comply with the file preparation requirements for uploaded content. Detailed technical specifications and requirements for custom design files (resolution, formats, color profiles) are available here: https://picwall.com/lt/failu-parengimo-reikalavimai/

c) understands that they are fully responsible for the quality and resolution of the uploaded file and its suitability for large-format printing, as well as for the required wallpaper dimensions. The Service Provider guarantees the quality of the production process, but is not responsible for the final result (image graininess, blurriness, or pixelation) if the submitted file did not meet the technical recommendations specified on the Picwall website, but the Visitor nevertheless confirmed it at the time of ordering. Once the Visitor has confirmed the custom design file and paid for the order, the submitted image is considered final and appropriate. Any deficiencies subsequently noticed relating to the quality, content, resolution, or errors of the submitted file are not considered a product defect or manufacturing fault. More information on how to correctly measure walls can be found here: https://picwall.com/lt/kaip-teisingai-ismatuoti-sienas/ Other frequently asked questions: https://picwall.com/lt/duk/

d) confirms and guarantees that they hold all copyrights or lawful usage licenses for the uploaded content. It is strictly prohibited to use intellectual property belonging to third parties without their written consent.

e) understands that the on-screen color rendering (RGB) and the actual print on the wallpaper (CMYK) may differ slightly due to different monitor settings and material textures.

f) must, prior to submitting the order, carefully review the order details for possible errors or inaccuracies in dimensions or the custom layout, since once the order has been submitted, the Visitor will not be able to correct it and will be required to cover all costs of fulfilling the order. More information on how to correctly measure walls can be found here: https://picwall.com/lt/kaip-teisingai-ismatuoti-sienas/ Other frequently asked questions: https://picwall.com/lt/duk/

g) The Customer confirms that by uploading any image to the custom wallpaper creation tool, they hold all necessary economic and moral copyrights to this content, or have obtained the owner's permission to use it for commercial (production) purposes. Full responsibility for the uploaded content and any possible violation of third parties' intellectual property rights rests with the Customer. The Company assumes no responsibility for the content of images uploaded by the customer.

4.3. The Visitor is fully responsible for the accuracy and correctness of the data provided in the order form. If the Visitor provides inaccurate or incorrect data in the order form, Picwall is not liable for the resulting consequences and acquires the right to claim compensation from the Visitor for direct losses incurred.

4.4. Before purchasing Picwall Products, the Visitor must additionally provide a delivery address required for delivery (unless the Visitor chooses pick-up at a collection point).

4.5. When the Visitor clicks the "ORDER" link, a purchase-sale agreement is deemed to have been concluded between the Visitor and the Service Provider for the acquisition of the Picwall Product, and from this moment the Visitor is referred to as the Buyer, and the Service Provider as the Seller.

5. Conclusion of the Purchase-Sale Agreement

5.1. Purchase-Sale Agreement — an agreement concluded between the Buyer and the Seller for the ordering/purchase of Picwall Products, consisting of the Picwall product order application (submitted by the Buyer to the Service Provider via the Picwall website) and these Rules, together with any subsequent amendments and additions.

5.2. The Buyer must keep the order number safe and not disclose it to third parties who are not entitled to collect the ordered Picwall Products on the Buyer's behalf. If the order number becomes known to other persons through no fault of the Buyer's own disclosure, the Buyer must immediately inform the Seller using the contact details specified in the agreement. If the Seller does not receive such notice of unauthorized disclosure of the order number, the person presenting the number is deemed authorized to receive the product(s), and the product(s) will be deemed to have been properly delivered to the Buyer.

6. Buyer's Obligations

6.1. By checking the box confirming agreement with the Rules, the Buyer must comply with these Rules and other conditions, and must not violate the laws of the Republic of Lithuania and the European Union.

6.2. The Buyer must pay for the ordered Picwall Product and accept it in accordance with the procedure set out in these Rules.

6.3. Under Article 6.228(10), Paragraph 2, Point 3 of the Civil Code, the Buyer does not have the right to withdraw from the purchase-sale agreement if the agreement was concluded for products made to the consumer's special (individual) specifications, which are not prefabricated and are manufactured taking into account the consumer's personal choice or instruction, or for goods that are clearly personalized for the consumer. By agreeing to these Rules, the Buyer confirms that they understand that the ordered product (wallpaper) is clearly personalized to the Buyer's individual needs and is manufactured taking into account the Buyer's personal choice and instructions, and therefore the Buyer acknowledges and agrees that, once the order is submitted and paid for, they will lose the right to withdraw from the purchase-sale agreement, except as provided for in Clause 7.2.

6.4. The exception set out in Clause 6.3 of these Rules does not apply to canvases purchased from the Picwall design catalog, since canvases are manufactured according to designs and standard dimensions predetermined by Picwall and are not individually customized according to the Buyer's personal instructions or choice.

6.5. A Buyer who is a natural person (consumer) and has purchased a canvas has the right, within 14 (fourteen) calendar days from the date of delivery of the product, to withdraw from the purchase-sale agreement without giving a reason and without incurring any costs related thereto, except for the direct costs of returning the product.

6.6. In order to exercise the right set out in Clause 6.5, the Buyer must, before the deadline expires, clearly inform Picwall of their decision to withdraw from the agreement by submitting an unambiguous statement to pagalba@picwall.com.

6.7. The returned canvas must be unused, undamaged, and in a condition suitable for sale (with labels not removed, if any, and packaging undamaged, where this can be verified without opening the packaging), together with all accessories and documents received with the product. The Buyer is liable for any diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the product.

6.8. The direct costs of returning the product, if the Buyer exercises the right set out in Clause 6.5, are borne by the Buyer.

6.9. Picwall undertakes to refund the Buyer all amounts paid for the canvas no later than 14 (fourteen) days from the date on which it received the Buyer's notice of withdrawal from the agreement. Picwall has the right to withhold the refund until the product has been returned to Picwall or until the Buyer provides proof that the product has been sent back, whichever occurs first. Refunds are made using the same method as the original payment, unless the Buyer expressly agrees to another method that does not result in additional costs for them.

7. Buyer's Rights

7.1. The Buyer, by using the services of the Picwall website, has the right to create and place orders for Picwall Products and to purchase them in accordance with these Rules.

7.2. A Buyer who receives a defective product with an obvious defect (an obvious defect being one identifiable by visual inspection before the Product is put into use) has the right to withdraw from the concluded purchase-sale agreement by notifying the Seller in writing (by email: pagalba@picwall.com) no later than 5 (five) business days from the date of delivery of the product, indicating in the notice the product to be returned, its order number, and the reason for the return. If the defect is not obvious (hidden) and could not have been detected upon inspection, the Buyer must inform the Seller of it without delay, and no later than 2 business days from the moment such defect becomes apparent.

7.3. The Buyer may exercise the right described in this clause in accordance with the product return conditions set out in Section 14, and only where the Seller is responsible for the product defect and provided that the product was not damaged by the Buyer or its appearance was not materially altered through the Buyer's fault.

8. Seller's Obligations

8.1. The Seller undertakes to enable the Buyer to use the services of the Picwall website and to purchase Picwall Products.

8.2. The Seller undertakes to deliver the products purchased by the Buyer to the specified address, in accordance with the conditions set out in these Rules.

8.3. The Seller undertakes to respect the Buyer's right to privacy regarding their personal information.

8.4. If the Buyer exercises the right set out in Clause 7.2 of the Rules, in accordance with the conditions and procedure of Section 14, and only where the Seller has breached its obligations, the Seller undertakes to refund the amounts paid by the Buyer within 7 (seven) business days, counted from the date the returned product is received.

9. Seller's Rights

9.1. If the Buyer in any way attempts to harm the Seller's operations, good name, or reputation, or data security, or violates other obligations of the Buyer set out in these Rules, acts unfairly toward the Seller, attempts to circumvent the Rules through deception, or abuses the privileges and/or discounts granted, the Seller has the right, at any time, to revoke the Buyer's access to the Picwall website or to fully or partially restrict the ability to use the Picwall website's database and/or services.

9.2. The Buyer agrees that the Seller shall unilaterally decide whether the Buyer has violated the Rules, and undertakes to recognize such a decision by the Seller as lawful and correct.

10. Product Manufacturing

10.1. Production of the product will begin only after the Seller receives payment for the ordered Picwall Product(s).

10.2. The manufacturing lead times for Picwall Products are specified on the Picwall website in the "Production and Delivery Terms" section.

10.3. If the Buyer does not receive confirmation of the manufacturing or dispatch of the Picwall Product within 14 business days, they must contact the email address listed on the Picwall website in the "Contacts" section, indicating the order number.

10.4. The Seller is not responsible for the color of the Picwall Product possibly not matching the color of the product photo as displayed on the Buyer's monitor. Color rendering depends on the settings of the Buyer's device screen (resolution, brightness, contrast, color mode) and lighting conditions.

10.5. Picwall products are manufactured in the European Union.

10.6. By agreeing to these Rules, the Buyer confirms that they have no objection to the Seller's trademark or other identifying mark being used on the manufactured Picwall Product. The Seller undertakes to apply the trademark in a manner that does not materially detrimentally affect the final aesthetic appearance of the Picwall Product. The presence of the Seller's trademark or other identifying mark on the Picwall Product is not considered a quality defect or a non-conformity with the Buyer's order.

11. Prices of Picwall Products

11.1. Prices of Picwall Products are stated in euros. VAT is included in the price. VAT invoices are issued in euros.

12. Payment Procedure for Picwall Products

12.1. The Buyer pays for the ordered product(s) via electronic banking through the Paysera and PayPal payment systems, with advance payment made using the Buyer's electronic banking system.

12.2. Payment is deemed received at the moment the Seller receives the payment order into its bank account.

12.3. If payment is not received, the Seller will keep the Buyer's order in the system for 15 days. If the Seller does not receive payment within these 15 days, the order is cancelled.

13. Delivery of Picwall Products

13.1. The Seller undertakes to deliver the ordered product to the Buyer in accordance with the terms specified on the Picwall website in the "Production and Delivery Terms" section, and undertakes to make every effort to deliver the purchased product as quickly as possible. The Buyer agrees that, due to unforeseen circumstances beyond the Seller's control, the delivery time for products may differ from the terms specified in this section or from the delivery time agreed between the Buyer and the Seller.

13.2. Ordered products are delivered using the delivery method specified by the Buyer in the product order application. Delivery rates are specified on the Picwall website in the "Production and Delivery Terms" section. The Buyer undertakes to provide an exact delivery address and contact phone number.

13.3. Once the Seller has dispatched the shipment, the Buyer will be provided with a tracking number, which can be used to track the shipment from the moment the Seller dispatches it until the Buyer receives/collects it. The shipment's route can be monitored via the courier/shipping company's "shipment tracking" self-service tool.

13.4. If products are delivered by the Seller's authorized representative, i.e., a courier/shipping company or similar, the product is handed over to the Buyer, and the fact of handover is recorded in accordance with the procedure established by the courier/shipping company.

13.5. A Buyer who has chosen delivery via courier/shipping company undertakes to personally accept the ordered product. In cases where the Buyer is personally unable to accept the product, and the product has been delivered to the address specified by the Buyer based on other data provided by the Buyer, the Buyer has no right to raise claims against the Seller regarding delivery/handover of the product to the wrong recipient.

13.6. A Buyer who has chosen delivery via parcel locker will receive an SMS notification about the shipment's delivery and the time period within which the recipient must collect the shipment.

13.7. A shipment that could not be delivered to the Buyer (the Buyer does not collect the shipment from the parcel locker within the period specified in the SMS notification, or is unreachable at the specified address during courier delivery, provides incorrect delivery data, or does not provide a contact phone number, etc.) is returned to the Seller, and the return costs are passed on to the Buyer. A Buyer who fails to collect the shipment undertakes to compensate the Seller for the shipping and return costs (for courier/shipping services) in an amount of no less than EUR 4.49.

13.8. If the product is not delivered to the Buyer, or is delivered late, the Buyer must immediately inform the Seller by email at pagalba@picwall.com. If the Buyer fails to take this action, the Seller is released from liability to the Buyer.

13.9. Upon receiving the product, the Buyer must check the condition of the shipment and the product(s). If the Buyer notices that the packaging of the delivered shipment is damaged (crushed, wet, or otherwise externally damaged), that the product(s) are damaged, and/or that the product(s) are of the wrong configuration, the Buyer must note this in the delivery document provided by the courier, or draw up a separate report on these defects with the courier present, and must, without delay and no later than 2 (two) business days from the date of receipt of the shipment, notify the Seller by email at pagalba@picwall.com, indicating the fact of the product's defect (non-conformity) and its cause. If the quality of the product was not affected despite damaged packaging, the Buyer may accept the product while notifying the Seller by email at pagalba@picwall.com that only the shipment's packaging was damaged. If the Buyer fails to take these actions, the Seller is released from liability to the Buyer for product defects (unless the cause of such defects is a manufacturing fault) and for non-conformities in the product configuration, if such non-conformities could be identified by inspecting the product. If the Buyer fails to notify the Seller of product defects or non-conformities within the period set out in this clause, the shipment is deemed to have been delivered in proper condition, with no product defects (other than those caused by a manufacturing fault) and no non-conformities in the product's configuration.

13.10. When Picwall Products are sent/delivered outside the Republic of Lithuania and/or the EU customs union, import duties may apply to the product(s). Import duties are not included in the product price. The Buyer is solely responsible for paying any taxes related to the Product(s), including but not limited to any import duties, customs duties, VAT, and other taxes, if applicable.

14. Product Returns

14.1. A quality wallpaper product cannot be exchanged or returned, and money paid for it will not be refunded, since wallpaper is manufactured according to the Buyer's individual order (chosen dimensions, design, specifications). Pursuant to Article 6.228(10), Paragraph 2, Point 3 of the Civil Code of the Republic of Lithuania, quality custom wallpaper products are not subject to return or exchange. This provision does not apply to canvases — the Buyer's right to withdraw from the purchase-sale agreement for a quality canvas is set out in Clauses 6.4–6.9 of these Rules. The return or exchange procedure for product quality defects (for both wallpaper and canvases) is governed by Clauses 14.2–14.6 of this section.

14.2. The Seller is not responsible for defects arising from improper surface preparation, use of unsuitable adhesive, or failure to follow the wall covering (wallpaper) installation instructions. If a product defect is identified during installation, work must be stopped immediately. Claims regarding product defects that could have been noticed at an earlier stage of installation, but where work was nevertheless continued, will not be accepted.

14.3. If the Buyer, together with Picwall Products, purchased supplementary goods (adhesive, tools, paint, etc., hereinafter — Supplementary Goods), the Buyer has the right to withdraw from the purchase-sale agreement for the Supplementary Goods within 14 (fourteen) days of receiving them, without giving a reason, in accordance with the general goods return rules, i.e., provided that the goods are unused, unopened (with undamaged protective packaging), in their original and proper packaging, and with a complete set of components.

14.4. The Buyer may exercise the right to return a defective product within 5 (five) business days from the date of delivery of the product by notifying the Seller in accordance with the procedure set out in Clause 7.2 of the Rules. The Seller will generate a return shipping label and send it to the Buyer by email. The return shipping label received must be affixed to the securely packaged shipment. The shipment may be returned in whatever manner is convenient for the Buyer — by courier or parcel locker — regardless of how the Buyer received the shipment. The costs of returning a defective product are borne by the Seller.

14.5. When returning a defective product, the following additional conditions must be observed:

14.5.1. The returned product must not have been damaged or used by the Buyer;

14.5.2. The returned product should preferably be returned in the Seller's packaging or in other packaging ensuring safe transport/shipping;

14.5.3. When returning the product, a document confirming its purchase must be provided;

14.5.4. The Seller has the right to refuse to accept products returned by the Buyer if the return conditions were not complied with.

14.6. If the Seller is responsible for a product defect and the defect cannot be remedied, money paid for returned products will be refunded to the Seller only by bank transfer to the payer's bank account.

15. Complaints, Negative Feedback, or Reviews

15.1. The Seller strives to provide the Buyer with an excellent experience when purchasing Picwall Products; however, if the Buyer is dissatisfied with a Picwall Product or its services, the Buyer is invited to first contact the Seller directly at pagalba@picwall.com, so that the Seller may resolve the dissatisfaction or problem as quickly as possible.

15.2. Upon receiving a customer complaint, negative review, or feedback, the Seller will make every effort to find the most appropriate individual solution to satisfy the Buyer's complaint or dissatisfaction.

15.3. If the Buyer disagrees with the response or solution received, or has additional important information that was not previously provided or considered, the Buyer is encouraged to contact the Seller again.

15.4. If no solution is reached, or if the Buyer remains dissatisfied with the solution, the Buyer may make use of other dispute resolution methods specified in Section 19 of these Rules.

16. Provision of Information

16.1. The Seller provides information to the Buyer using the email address provided in the registration form, and the Buyer may use any of the communication channels listed on the Picwall website in the "Contacts" section.

16.2. By agreeing to these Rules, the Buyer agrees to receive informational messages at the email address provided, necessary for placing the order, making payment, and delivering the product.

17. Liability

17.1. The Visitor/Buyer undertakes to fully compensate the Service Provider/Seller, or any other person to whom the Visitor/Buyer caused harm through their actions while using the Picwall website and/or its services, for damages arising from justified written claims made by third parties regarding violations of their rights.

17.2. The Service Provider/Seller is released from any liability in all cases where losses arise because the Visitor/Buyer, disregarding the Service Provider's/Seller's recommendations and their own obligations, failed to review these Rules, even though such an opportunity was provided to them.

17.3. In the event of damage, the party at fault shall compensate the other party for direct losses.

18. Promotions

18.1. The Seller may run various types of promotions, and may change their conditions or terminate them at any time. Information about ongoing promotions is provided on the Picwall website.

18.2. If the Visitor/Buyer has chosen to consent to the use of their provided data for direct marketing purposes, the Service Provider/Seller may send the Visitor/Buyer information about the promotions referred to in this section via the email and/or SMS provided, not including messages by which the Seller informs the Buyer about the status of a submitted order.

18.3. The provisions of this section apply only to promotions organized by the Service Provider/Seller and do not apply to promotions organized through the Service Provider's/Seller's Intermediaries. In such cases, the Visitor/Buyer must comply with the coupon purchase-sale rules established by the Service Provider's/Seller's Intermediaries, which the Buyer agrees to when purchasing coupons.

19. Final Provisions

19.1. These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.

19.2. Relationships arising on the basis of these Rules are governed by the law of the Republic of Lithuania.

19.3. All disagreements arising from the performance of these Rules shall be resolved through negotiation. If no agreement can be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania, according to the place of business of the Service Provider/Seller.

19.4. Consumer disputes are resolved out of court in the Republic of Lithuania by the State Consumer Rights Protection Authority, registered address: Vilniaus g. 25, LT-01402 Vilnius, www.vvtat.lt.

19.5. Requests or complaints regarding a product purchased on the Picwall website may be submitted via the Online Dispute Resolution platform: http://ec.europa.eu/odr/.

19.6. These Rules were last updated on 2026-02-10.
